  가수 영탁(본명 박영탁)이 모델로 활동했던 예천양조 대표 백모 씨에게 징역 6개월에 집행유예 1년이 선고됐다. 지난 17일 서울동부지법 형사8단독 김선숙 판사는 정보통신망 이용 촉진 및 정보보호 등에 관한 법률 위반(명예훼손) 혐의로 기소됐다. 이들은 가수 영탁과 영탁을 모델로 제조 판매한 ‘영탁막걸리’에 대해 ‘영탁 측과 상표권 사용 및 모델 재계약 협상 중 영탁 측이 모델로 150억 원을 요구했다.’라는 허위사실 공표 혐의다. 그리고 명예훼손·협박 혐의로 함께 기소된 예천양조 서울지부 지사장 조모 씨도 같은 형을 받았다. 조 씨는 재계약 불발과 관련 사실을 언론에 알리겠다고 협박한 혐의다. 백씨 등은 지난 2021년 언론 공개와 유튜브에서 “영탁 측이 1년에 50억 원씩 3년간 총 150억 원 요구와 무상 대리점 운영권을 달라고 요구했다.”라고 주장했다. 또 “막걸리 상표권 관련 등록을 위해 특허청에서 본인 승낙서를 요구해 영탁 어머니에게 요청했으나 얼마 뒤 영탁 측이 몰래 상표권을 출원했다”라고 주장했다. 또 백씨는 “돼지머리를 신문지에 싸서 묻지 않으면 회사가 망한다”라며 영탁 모친의 말에 “고사 및 굿 비용을 지급했다.”라며 “계약 결별과 갈등으로 팬들이 조직적 불매운동으로 일부 대리점 폐업 및 매출이 감소했다”라고 주장했다. 앞서 서울 지사장 조모 씨는 “협상 결렬 사실을 언론에 공개해 이미지가 실추돼도 상관없느냐?”라는 명예훼손과 협박한 협의다. 영탁 측은 예천양조 측이 허위사실을 주장한다며 같은 해 8월 백모 대표 등을 명예훼손 혐의로 고소했다. 이에 법원은 “영탁 측이 연간 50억 원 등 과도한 광고 모델료를 요구해 협상이 결렬됐다”라는 주장은 허위. 또 영탁 측과 상표권 등록승낙이 아니며 사용승낙임을 알고도 회사 측 상표권 등록을 방해한 것으로 허위사실을 유포했다고 판단했다. 또 영탁 모친의 ‘돼지머리 고사’에 대해 강요가 없었고, 팬들의 조직적 불매운동도 없었다는 게 법원 판단이다. 법원의 양형 이유에 대해서는 “백씨 등이 상표권 협상 관련 만남 과정에서 사실과 허위를 교묘히 섞어 언론과 대중에게 영탁 측의 갑질이 있었던 것처럼 공표해 영탁 모친의 명예를 훼손하고 협박했다”라며 “피해자는 이 사건으로 대중의 비난과 상당한 정신적 고통을 받았다”라고 밝혔다. 또 법원은 백씨의 허위사실 언론 공개 배경에는 영탁과 모델 계약을 체결 후 매출이 급성장했다. 그리고 공장신축에 따라 계약 연장이 절실했기 때문이라고 봤다. 실제 예천양조의 매출액은 2019년 기준 1억 1,543만 원이었다. 영탁과 전속 모델 계약을 체결한 이듬해엔 50억 1,492만 원으로 약 50배가량 증가했다. 영탁 측이 예천양조 상대로 상표권 사용 금지 청구 소송에서 지난 7월 원고 일부승소를 판결받았다. 무고·업무방해·명예훼손에 대한 예천양조의 고소에 대해 모두 각하 또는 무혐의로 처분받았다.

  세계적인 인기 그룹 BTS(방탄소년단)의 리더 RM(랩몬스터)이 또다시 부산시립미술관을 찾아 전시를 관람한 것으로 알려져 화제다.부산시립미술관은 지난 17일 RM이 자신의 사회관계망서비스(인스타그램)에 《한국현대미술작가조명Ⅳ-이형구》 전시의 〈Felis Catus Animatus & Mus Animatus〉와 《나는 미술관에 ●●하러 간다》 전시의 〈시험시간(선우훈)〉, 자화자찬(안은미)〉 등 3점의 작품을 찍은 사진을 게시했다고 밝혔다.RM이 부산시립미술관에 방문한 것은 이번이 네 번째다. 지난 2019년 6월에는 미술관의 전시를 관람한 뒤 별관 이우환공간에 ‘잘 보고 갑니다 선생님, 저는 ‘바람’을 좋아합니다’라고 남긴 방명록이 큰 주목을 받았으며, 지난 2020년 5월에는 한국현대작가조명 ‘김종학’ 전을 관람 후 ‘김종학 선생님의 ‘기운생동’으로 쉽지 않은 시기, 같이 잘 이겨나갔으면 합니다’라고 적은 방명록 역시 화제가 된 바 있다. 올해 2월에는 《크리스티앙 볼탕스키:4.4》 전시 작품 사진을 통해 전시 관람을 인증하기도 했다. 이번에 RM이 인증사진을 남긴 작품 중 《한국현대미술작가조명Ⅳ-이형구》 전시의〈Felis Catus Animatus & Mus Animatus〉는 워너 브라더스 애니메이션인 ‘톰과 제리’ 캐릭터를 모티브로 하고 있다. 이 전시는 몸을 주제로 20여 년간 다채로운 작품활동을 펼쳐온 이형구 작가의 개인전이며, 오는 8월 7일까지 진행된다. 작가의 초기작부터 최신작까지 약 100점의 작품을 부산시립미술관 2층에서 만나볼 수 있다.또한, RM이 인증사진을 남긴 나머지 2개 작품이 있는 《나는 미술관에 ●● 하러 간다》 전시는 ‘여가’를 주제로 기획돼 동시대 여가 현상과 활동을 탐색해보는 안내서와 같은 전시다. 스스로에게 필요한 진정한 여가를 찾기 위해 매주 수요일에서 토요일까지 배움, 요가, 드로잉, 명상 등 100여 회에 이르는 프로그램이 전시장에서 제공되고 있다. 매월 셋째 주 목요일마다 부산시립미술관 누리집을 통해 다음 달 프로그램을 선착순으로 참가 신청할 수 있으며 오는 10월 16일까지 진행된다.기혜경 부산시립미술관장은 “RM의 방문으로 부산시립미술관의 전시뿐만 아니라 지역의 문화예술이 주목받을 수 있도록 다양한 홍보방안을 마련하겠다”라고 밝혔다.
